Gift deed registration is mandatory. A Gift is the transfer of certain movable or immovable property made voluntarily and without consideration, by one person, called the Donor, to another, called the done and accepted by or on behalf of the Donee. The acceptance of the gift must be made during the life of the Donor, while he is steel capable of giving it, and should be accepted before the death of the Donee.
Essentials of valid Gift
1) It must be made by the owner of the property, who has capacity to enter into a binding contact.
2) It must be made voluntarily and without consideration.
3) There must be absolute transfer of ownership of the property, which must be in existence.
4) Acceptance of the gift must be made during the lifetime of the donor while competent to contact and before donee dies.
5) It must be registered if it relates to an immovable property of whatsoever valuation it may be.
6) It should have requisite stamp duty.
